Terms & Conditions

Please read these Terms & Conditions carefully before engaging Evoke Design Studio for services or using this website. By booking a service, signing a proposal, or using evokedesignstudio.com, you agree to be bound by these terms.

1. About Evoke Design Studio

Evoke Design Studio is a boutique branding and website design studio owned and operated by Eva Eriksson ("we," "us," "our"). We provide branding, website design, and related creative services to wellness professionals, retreat leaders, and purpose-driven businesses.

2. Services

The scope, deliverables, timeline, and investment for each project are outlined in a project proposal sent to the client prior to commencement. Work begins only after the proposal has been accepted and the deposit invoice has been paid in full.

We reserve the right to decline any project at our discretion.

3. Payments & Deposits

Deposit: A non-refundable deposit of 50% of the total project fee is required to secure your project start date. No work will begin until the deposit is received.

 

Final payment: The remaining 50% is due upon project completion, prior to the delivery of final files. Final files will not be released until the balance is paid in full.

 

Brand Clarity Sessions: Payment is due in full at the time of booking. Sessions are non-refundable but may be rescheduled with a minimum of 24 hours' notice.

 

Late payments: Invoices are due within 7 days of issue. Late payments may result in work being paused until the outstanding balance is settled.

 

Currency: All prices are quoted and invoiced in US dollars (USD) unless otherwise agreed in writing.

4. Revisions

Each package includes a specified number of revision rounds as outlined in the project proposal. Revisions must be submitted in a single consolidated document or message per round. Additional revisions beyond those included will be quoted and billed separately at our standard hourly rate.

 

Revision rounds apply to refinements of approved concepts — they do not apply to changes in direction, scope, or brief after a concept has been approved. Significant changes to the agreed brief may be treated as a new project or result in additional fees.

5. Client Responsibilities

To keep your project on schedule, you agree to:

  • Provide all required content, materials, and feedback in a timely manner

  • Respond to questions and review requests within the agreed timeframe (typically 5 business days)

  • Designate a single point of contact for all project communication

 

Delays caused by late feedback or missing content may result in the project timeline being adjusted. Extended delays of 30 days or more without communication may result in the project being considered abandoned, with the deposit forfeited.

6. Intellectual Property & Ownership

Before final payment: All creative work produced by Evoke Design Studio remains our intellectual property until the final invoice is paid in full.

 

After final payment: Upon receipt of full payment, the client receives full ownership of the final approved deliverables — including logos, brand assets, and website design — for use in their business.

 

Original concepts: Any concepts, sketches, or design directions that were not selected by the client remain the property of Evoke Design Studio and may be used in our portfolio or adapted for future projects.

 

Portfolio rights: We reserve the right to display completed work in our portfolio, on our website, and across our social media channels unless a written confidentiality agreement has been signed. Please let us know at the start of the project if you require confidentiality.

7. Confidentiality

We treat all client information as confidential. We will not share your business information, project details, or personal data with third parties except where required by law or necessary to deliver your project (for example, a web hosting platform).

8. Cancellations

If you wish to cancel a project after work has commenced, the following applies:

  • The deposit is non-refundable in all circumstances

  • If work beyond the deposit value has been completed at the time of cancellation, a proportional fee for work completed may be invoiced

  • Any completed work will be delivered to you upon settlement of outstanding fees

 

We reserve the right to cancel a project if the working relationship becomes untenable, feedback is not received within agreed timeframes, or payment obligations are not met. In such cases, fees for work completed will remain payable.

9. Warranties & Liability

We deliver all work with care, skill, and professional judgment. However:

  • We do not guarantee specific business outcomes, increased bookings, or revenue as a result of our design work

  • We are not liable for any losses, direct or indirect, arising from the use of deliverables after project completion

  • It is the client's responsibility to ensure that all content, names, and trademarks provided to us do not infringe on third-party rights

  • Our total liability in any circumstances is limited to the total fees paid for the relevant project

10. Website Use

By using evokedesignstudio.com you agree not to:

​

  • Use the site for any unlawful purpose

  • Copy, reproduce, or redistribute any content from this site without written permission

  • Attempt to gain unauthorised access to any part of the site

 

We reserve the right to update, modify, or remove content from this website at any time without notice.

11. Changes to These Terms

We may update these Terms & Conditions from time to time. The current version will always be available at evokedesignstudio.com/terms-and-conditions. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the State of California, United States. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts of California.
